There definately needs to be some sort of checks and balances here. But, by exposing this program, we have all been put in danger.
The people that exposed this program comitted treason and should be punnished fully.
HOWEVER, the administration has to explain why they did not use the existing legal system to do what they did. If they did not believe the system was secure, or fast enough, they needed to change it.
Richard, I agree that there probably was a set of checks and balances in place and that the Bush Administration SHOULD have used it. My question is, why did they not? Did they not trust the security of the FISA Court to be kept confidential? Did they not think that they needed the court approval? Their flip-flop (note the irony here) and lack of public addressing of this issue is very concerning to me. I argue that the 'leaker', however good intentioned, definitely has put us at greater risk. Unless you totally discount the Bush claim that this was part of the 'War on Terror' you must agree that however 'illegal' this may have been, this was a key tool in their arsenal. This leaker should be punished.
Now something else to consider. If we are at war. Does the President of the US have the authority to do such things? And if we are at 'war' doesn’t the president have to declare 'war' or something so that he has these powers?
As far as the comparison to outing Plame.. Please! You are assuming that I do not think that Scooter and Friends Inc. should be punished... I do. However, I am not convinced that she was 'covert' and I am convinced that she and her husband had their own agenda. I am not saying that two wrongs make a right. Or that two rights make a left. Or that two lefts make a right... Whatever... I am saying that this partisanship sucks. Thus PURPLE PARTY...
